Key Agencies and Their Roles

As an employer works through the process of hiring a temporary foreign worker (TFW), there are several agencies that they will see referenced, or have actual contact with. 

The following are a few of these agencies involved and their respective roles:

In Canada, the Immigration and Refugee Protection Act (IRPA) regulates the entry of temporary foreign workers into the country.  The program is jointly managed by Human Resources and Social Development Canada (HRSDC)/Service Canada, Citizenship and Immigration Canada (CIC) and the Canada Border Services Agency (CBSA).

What is the role of Human Resources and Social Development Canada (HRSDC)/Service Canada?

HRSDC and Service Canada work with employers that want to hire foreign workers. Foreign worker applications are reviewed and an opinion is issued to a prospective employer on the potential labour market impact and possible repercussions for Canadian jobs.  Service Canada refers to this process as issuing an employment confirmation or a Labour Market Opinion (LMO).  Service Canada prepares an LMO that assesses each individual request to ensure that employers offer prevailing wage rates and acceptable working conditions.  It also ensures the employer has made adequate recruiting efforts in Canada before offering a job to a foreign worker.


What is the role of Citizenship and Immigration Canada (CIC)?

CIC and the Canada Border Services Agency work with foreign workers who want to work in Canada by reviewing applications from foreign workers and issuing work permits.  This takes place after HRSDC/Service Canada has issued a positive LMO and the employer has made a formal employment offer to the prospective employee(s). In most cases, CIC is the first point of contact for foreign workers, although in certain circumstances they may apply for a work permit at a port of entry.


What is the role of the Canada Border Services Agency (CBSA)?

Border Services officers screen foreign workers at Canadian border crossings and airports to ensure that they meet admissibility requirements before allowing them to enter Canada.  A Border Services officer has the final say on who may enter the country.
